1. Acceptance of Terms

By creating an account or using CartixAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using CartixAI on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

CartixAI provides a Software-as-a-Service (SaaS) platform that enables businesses to:

Connect their WhatsApp Business API account
Automate customer conversations using AI
Manage products, inventory, and orders
Create and operate online storefronts
Run marketing campaigns via WhatsApp

3. Account Registration

You must provide accurate, current, and complete information when registering. You are responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access at [email protected].

4. WhatsApp Business Usage

When connecting your WhatsApp Business API account:

You retain full ownership and control of your WhatsApp Business Account
You must comply with WhatsApp's Business Policy and Terms of Service
You are responsible for obtaining appropriate consent from your customers before messaging them
CartixAI is a tool — your business is responsible for all communications sent through the platform
You may disconnect your WhatsApp account at any time

5. Subscriptions and Payment

CartixAI offers paid subscription plans as described on our pricing page. By subscribing:

You authorize us to charge your selected payment method on a recurring basis
Subscriptions auto-renew unless cancelled before the renewal date
All prices are in Pakistani Rupees (PKR) unless otherwise stated
Payment failures may result in service suspension

6. Free Trial

New accounts receive a 3-day free trial with access to all features. After the trial period, you must select a paid plan to continue. We reserve the right to modify or end free trial offers at any time.

7. Acceptable Use

You must not use CartixAI to:

Send spam, unsolicited messages, or violate WhatsApp's messaging policies
Engage in fraud, deception, or misrepresentation
Sell illegal products or services
Harass, abuse, or harm any person
Violate any applicable laws or regulations
Attempt to reverse engineer or compromise the platform
Use the service to impersonate any person or entity

8. Intellectual Property

CartixAI retains all rights to the platform, software, and underlying technology. You retain ownership of your business data, content, and WhatsApp account. You grant CartixAI a limited license to process your data solely to provide the service.

9. Data and Privacy

Your use of CartixAI is governed by our Privacy Policy, which is incorporated into these Terms. You are responsible for complying with applicable data protection laws in relation to your customers' data.

10. Limitation of Liability

To the maximum extent permitted by law, CartixAI is not liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunity
Issues arising from third-party services (WhatsApp, payment gateways)
Service interruptions beyond our reasonable control

Our total liability to you shall not exceed the amount paid by you in the 3 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your access to CartixAI ceases, and your data is retained for 30 days before permanent deletion. We may suspend or terminate accounts that violate these Terms without notice.

12. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Disputes shall be resolved through arbitration in Islamabad, Pakistan, unless otherwise required by applicable law.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice in the platform. Continued use after changes constitutes acceptance.
